On 4 November 2026 the Council of the European Union published in the Official Journal of the European Union, L series, OJ L 2026/90946, a corrigendum to Council Decision (CFSP) 2026/455 of 26 February 2026 on restrictive measures to combat terrorism. The corrigendum, Council document ST/14654/2026/REV/1, replaces one paragraph of Article 10(2) of that Decision.
EU credit institutions screening payments against the EU terrorism asset-freeze list, EU payment institutions and electronic-money issuers applying Council Decision (CFSP) 2026/455, and EU insurers and reinsurers blocking funds of persons listed under that Decision must immediately re-map the Article 10(2) periodic review and the 22 February 2027 end date onto Article 2(10) and (11), and stop treating Article 2(8) as the time-limited exception, or a firm that applies the end date or the review to the wrong paragraph is off the corrected Council text and exposed to a national sanctions breach. The printed text had pointed the 24-month review, and the 22 February 2027 end date, at Article 2(8) and (9). The corrected sentence points them at Article 2(10) and (11).
What does OJ L 2026/90946 change in Article 10(2)?
Article 2(10) is the paragraph of Council Decision (CFSP) 2026/455 that the corrigendum to Article 10(2) places under the at-least-every-24-months review and that applies until 22 February 2027. On page 9 of the original Official Journal text (OJ L, 2026/455, 26 February 2026), Article 10(2) named the wrong paragraphs.
The text as printed read: the exceptions in Article 2(8) and (9) are reviewed at regular intervals and at least every 24 months, or at the urgent request of a Member State, the High Representative or the Commission following a fundamental change in circumstances, and Article 2(8) applies until 22 February 2027. The text as it must be read, in OJ L 2026/90946, keeps that review cadence and that end date, and moves both onto Article 2(10) and (11). Article 2(10) applies until 22 February 2027. Article 2(8) is no longer the paragraph that expires on that day.
| Point in Article 10(2) | Printed text (for) | Corrected text (read) |
|---|---|---|
| Exceptions under periodic review | Article 2(8) and (9) | Article 2(10) and (11) |
| Review cadence | At least every 24 months, or on an urgent request after a fundamental change in circumstances | Unchanged |
| End date | Article 2(8) until 22 February 2027 | Article 2(10) until 22 February 2027 |
Who has to remap the CFSP 2026/455 exceptions?
Credit institutions screening payments against the EU terrorism asset-freeze list, payment institutions and electronic-money issuers applying Council Decision (CFSP) 2026/455, and insurers and reinsurers blocking funds of listed persons are the actors a wrong paragraph number can misdirect. Obsidian tracks texts under EU Restrictive Measures (Sanctions) in 20 jurisdictions, as of November 2026. The corrigendum does not add or remove a listed person. A procedure that still cites Article 2(8) as the exception ending on 22 February 2027 is the text that is wrong. Follow OJ L 2026/90946, not a secondary copy of the 26 February 2026 page.
What must screening teams change immediately?
Screening teams must retarget the time limit and the periodic review, not rebuild the asset-freeze. Map the 22 February 2027 end date to Article 2(10), and map the at-least-every-24-months review to Article 2(10) and (11).
- Replace internal citations of Article 10(2) that still name Article 2(8) and (9) as the reviewed exceptions with Article 2(10) and (11).
- Retire any control that treats Article 2(8) as expiring on 22 February 2027, and attach that end date to Article 2(10).
- Check payment and insurance procedures that allow or block a transfer by reference to a numbered paragraph of Article 2, and align the paragraph number with the corrected sentence.
- Keep the review trigger as written: regular intervals, at least every 24 months, or an urgent request by a Member State, the High Representative or the Commission after a fundamental change in circumstances.
What happens if the old Article 2(8) mapping stays?
A firm that applies the 22 February 2027 end date, or the periodic review, to the wrong paragraph of Article 2 is off the corrected Council text and exposed to a national sanctions breach. The miss is a screening rule that expires Article 2(8) on 22 February 2027, or that reviews Article 2(8) and (9) instead of Article 2(10) and (11). National authorities enforce the measures under their own penalty regimes. The corrigendum sets no new fine.
Continuous per-jurisdiction monitoring is what surfaces an Official Journal corrigendum of this kind the moment it is published, before a stale cross-reference sits in a screening procedure.
Next, pull the corrected Article 10(2) from the Official Journal, confirm which internal rules still name Article 2(8) as the exception ending on 22 February 2027, and brief sanctions operations and financial crime. The base Decision remains Council Decision (CFSP) 2026/455 of 26 February 2026. Only the cross-references in Article 10(2) move.
